Terms of Service — DreamVoice (Yume no Koe)
1. Scope
These Terms of Service (“Terms”) govern your use of DreamVoice (“Service”). The Service is operated by Takahiro Nishinobu (the “Operator”). By using the Service, you agree to these Terms. The Service is intended for users aged 13 or older. Users under 13 may not use the Service. Minors should use the Service with guardian consent. If a higher age requirement applies under the applicable store age rating or local laws, that requirement applies.
2. Service
The Service lets you record dreams, Today's Voice records, and notes for small reflective questions, and provides AI-generated text (e.g., Dream Voice, Today's Voice feedback, symbols, and Weekly Dream Letters). Today's Voice is a feature that generates and displays gentle, non-diagnostic, non-medical text based on the user's input about today's events and feelings. A Weekly Dream Letter generates a reflection for a target week based on Dream Voice results, dream entries, and notes for small reflective questions from that period. Today's Voice is not used as a Weekly Dream Letter source in v1. The Service uses AI to generate text based on user input. It does not verify or determine the user's situation, intent, facts, legal status, medical status, psychological status, or similar matters. Some features require internet access.
3. Authentication & Support ID
The Service may use anonymous identifiers (e.g., for recognizing a user across sessions). A Support ID shown in the app may be used for support purposes.
4. Usage Limits
The Operator may set usage limits for AI features. Currently, daily Dream Voice generation is limited to 2 times per user per day, and Today's Voice generation is limited to 2 times per user per day as a separate quota. Weekly Dream Letters can be created when the target week has at least two completed Dream Voice days and daily generation for that week has finished. Weekly Dream Letters may also be subject to concurrent creation or frequency limits.
- The day boundary is based on the user’s time zone.
- Failed generations do not consume the quota.
- Weekly Dream Letter creation may take time, and the Service may notify you when it is ready.
- Limits and conditions may change; changes will be announced in a reasonable manner.
- The Operator may temporarily limit, suspend, or restrict retries for generation without prior notice when necessary due to server load, abuse prevention, external AI service availability, or operational reasons.
5. AI Output Notice
- AI output, including daily Dream Voice, Today's Voice, safety support notices, and Weekly Dream Letters, is provided as general reference only and is not medical, psychological, legal, or other professional advice or diagnosis.
- AI output is automatically generated based on user input. It does not mean that the Operator has verified the truth of the input, background circumstances, relationships with third parties, or the user's intent or condition.
- The Operator does not guarantee accuracy, completeness, usefulness, fitness for any purpose, or any expected effect of AI output.
- You should use AI output as reference information and make your own judgment when using it. Decisions, actions, sharing with third parties, and other results based on AI output are handled within the scope set out in Section 12.
- You must not rely on AI output for important decisions involving life, body, property, legal relationships, medical matters, psychological matters, interpersonal relationships, or similar matters. Consult professionals, public agencies, or trusted third parties as needed.
- The Service does not provide emergency response. In urgent or dangerous situations, contact local emergency services, qualified professionals, or trusted people immediately.
6. Safety Support
The Service may display information such as support resources when the input may include strong distress, self-harm, harm to others, isolation, or other safety concerns. This display does not diagnose or determine the user's condition and does not replace crisis intervention, emergency response, medical, psychological, legal, or other professional support. Whether safety support is displayed or not displayed does not indicate whether danger exists, whether the matter is urgent, or any medical, psychological, or legal judgment. The Operator does not guarantee the display, non-display, content, availability of linked resources, responses from linked resources, consultation outcomes, or any safety outcome. In a crisis, users should not rely on the Service and should immediately contact local emergency services, support hotlines, medical institutions, qualified professionals, or trusted people.
7. Prohibited Conduct
You must not:
- Violate laws or public order and morals.
- Infringe rights or interests of the Operator or third parties (e.g., copyrights, privacy).
- Misuse the Service or related systems (unauthorized access, tampering, reverse engineering, vulnerability probing, scraping, excessive load, spam).
- Bypass, tamper with, or improperly manipulate usage limits, authentication, security mechanisms, payment mechanisms, or similar restrictions.
- Use the Service as a substitute for medical, psychological, legal, financial, or other professional judgment or emergency response.
- Use the Service to encourage, plan, carry out, justify, or conceal self-harm, harm to others, illegal acts, crimes, violence, sexual abuse, harassment, threats, discrimination, evidence destruction, evasion of discovery, escape, or other acts that may cause damage or harm to third parties.
- Use AI output as grounds or justification for harming third parties, illegal acts, or acts that endanger yourself or others.
- Input or send third parties’ personal information, confidential information, or sensitive information without consent.
- Engage in other acts the Operator reasonably deems inappropriate.
If you breach these Terms, the Operator may restrict or suspend your use without prior notice and take necessary measures.
8. Responsibility for User Input
You are expected to manage and use the content you input, store, send, or share through the Service at your own discretion and responsibility. You should not unnecessarily input third-party personal information, confidential information, information that infringes rights, or illegal or inappropriate information. The Operator has no obligation to verify the truth, legality, or whether user input infringes third-party rights. Damages or disputes arising from user input or its use are handled within the scope set out in Section 12.
9. Intellectual Property & User Content
- Intellectual property rights in the Service (programs, design, trademarks, etc.) belong to the Operator or rightful owners.
- Rights to text and other material you input (“User Content”) remain with you or the rightful owner.
- You grant the Operator a non-exclusive, worldwide, royalty-free license to store, copy, transmit, analyze, and process User Content as necessary to provide, maintain, and improve the Service, including Dream Voice generation, Today's Voice generation, Weekly Dream Letter generation, notes for small reflective questions, storage, redisplay, notifications, deletion, support, and safety support notices. This includes transmission, storage, and processing by OpenAI, Google Firebase, and other service providers necessary to provide the Service.
- By using AI-generated features, you agree that User Content and related information necessary for generation may be sent to external AI services within the scope necessary to provide those features.
- AI-generated content (“AI Output”) may be used by you at your own responsibility. However, due to the nature of AI, identical or similar output may be generated for other users. The Operator does not guarantee the uniqueness, originality, or non-infringement of third-party rights of AI Output. Do not use AI Output in ways that infringe rights or violate laws.
- The Operator may use anonymized/aggregated statistics for analysis and improvement.
10. Data Deletion (Ending Use)
You can delete dream entries, Today's Voice records, question notes, and Weekly Dream Letters via in-app functions. If you delete a Weekly Dream Letter, that Weekly Dream Letter display is removed, but the individual dream entries, daily Dream Voice results, and notes for small reflective questions used as sources remain unless separately deleted. If you delete an individual dream entry or note for a small reflective question, an already generated Weekly Dream Letter may remain as a snapshot from the time it was generated. If you delete a Today's Voice record, the stored data, generated result, and related snapshot for that Today's Voice record are subject to deletion. When you delete your account, device data and related server data managed by the Operator will be removed (processing may take time). However, logs, backups, audit records, abuse-prevention records, legal-compliance records, and dispute-response records held by external services may remain for a certain period. 11. Changes / Suspension / Termination
The Operator may change, add, suspend, or terminate the Service. Significant changes or termination will be notified in a reasonable manner (in-app or web), except in emergencies.
12. Disclaimer
The Service is provided “as is.” The Operator does not warrant, expressly or impliedly, the completeness, accuracy, usefulness, continuity, operation, fitness for a particular purpose, or occurrence of effects expected by users.
AI output is reference information automatically generated based on user input. The Operator does not warrant the accuracy, completeness, usefulness, legality, or fitness of AI output for any particular purpose.
Except in cases of the Operator’s intentional misconduct or gross negligence, and to the extent permitted by law, the Operator is not liable for damages suffered by users or third parties arising from AI output, user input, reliance on AI output, user decisions or actions, use of external services or support resources, communication failures, system failures, data loss, unauthorized access, or any other use or inability to use the Service.
Safety support, support-resource information, external links, and similar information displayed in the Service are provided as reference information to support users' judgment. The Operator does not guarantee their accuracy, currency, availability, responses by third-party organizations, consultation outcomes, user safety, or any other result.
Even if the Operator is liable, such liability is limited, to the extent permitted by law, to ordinary and direct damages. The Operator is not liable for special damages, indirect damages, lost profits, emotional distress, or damages arising from disputes with third parties.
13. Fees
The Service is currently free. Paid features (e.g., subscriptions) may be introduced later; conditions (price, cancellation, refunds, etc.) will be provided at launch.
14. Changes to Terms
The Operator may amend these Terms. Continued use after the amended Terms take effect constitutes acceptance of the amended Terms.
15. Governing Law & Jurisdiction
These Terms are governed by Japanese law. The Tokyo District Court will have exclusive jurisdiction as the court of first instance.
